Assignment rule priority over Template

We have an issue where the incident template is selecting an assignment group. But there is also an assignment rule written which populates the assignment group based on the 'state/province' of the user. For now the assignment rule is overriding the template. But according to our process the template should override it.

How to allow template to override the assignment rule?

Do you have any custom field(template) or any unique field which can be identified on the form when this template is applied.

No, I don't have any such field on the form.

Is the Assignment Rule running when the User is clicking on Create New or something like that?

I think the assignment rule should work when the form is submitted. My problem is if the user selects a template, even then the assignment group in template is not populated because of the assignment rule.
