Issue with Email compose in Activity Stream

Hi Team,
In HR Case we have a customised field and when it is marked true the hr case should not be visible to other users apart the assignment group manager and assigned to.
We identified a strange behaviour with the Email section in Activity Stream in Agent workspace, when the customised field is marked true the case is restricting the view of details on case, comments, work notes but still users are able to see the Email Section in Activity stream of HR case.
ACL's/BR related to this field on sn_hr_core_case has been verified but we don't see any issue with these. Anu idea what causes this issue?
We identified this behaviour after upgrading to Zurich Patch 5

how are you restricting the visibility based on that Checkbox field?

Are you also restricting something else?

how are you restricting the visibility based on that Checkbox field? - yes
Are you also restricting something else? - Actually, when the checkbox is true the complete hr case will be restricted for the users. Now after upgrading to Zurich Patch 5, we are seeing email section from activity stream even though the checkbox is true.
