Then TRY with Plugin Repair once.
If still issue exist, Raise a case with Servicenow Vendor incase of client instance.

The Publish to Case & Notify UI action is a conditional button. It is only visible on the Case Action Summary form when a valid recipient list has been selected.
Refer: Activate Case Digests
"When creating a case action summary record, users with the sn_esm_agent role can select a recipient list of the type Internal Users. Selecting the Publish to Case & Notify UI action on the Case Action Summary form sends an email notification to the users included in the selected recipient list.

Condition satisified.
sn_esm_agent role is present
Receipenet list exist.
but sill it's not visible.
