Case creation option if the live agent chat is timed out or rejected by the agent

Hi,
I am trying to create a virtual agent designer flow, where if the live agent has rejected the chat or has not accepted an the waiting time has reached the max time of 5 minutes, then it should give the case creation option. How can this nodes be bult? What should be the logic to include in the rejection node and timeout node? How can this be achieved overall?
