When an HR Case gets opened for or from a person without an HR profile, than an HR Profile gets created and therefore on more license.
Question is when does this license gets inactivated, is it just for one year, or does is stay active until User record gets inactivated ?

The HR Profile remains there and active until you deactivate the User and put an employment end date on the HR Profile. If you have more questions around the licensing, I'd recommend talking to your ServiceNow account rep to make sure you are in compliance.
HR Profiles are created when cases are created for the user and when the user logs into Employee Center (EC). You can set a system property to prevent the creation from logging into EC though.

Hi Susan,
Thanks.
I was not aware of the sys prop.
Can you please name it, not sure we have deactivated it.

Hey! Sorry for the delay - I'm behind on my community emails. The system property is sn_hr_core.esc.create_hrprofile.override

I have been worked with ServiceNow regarding HR license for HR user licenses. It is very hard to control for new HR licenses like your case. If your planned licenses (entitlement) are 2000 , but you over used 200 like your case, ServiceNow will count your HR license # 2200 during each year ServiceNow contract review.
I hope this will help you.
