Applicant Privacy Statement

Purpose and Scope

This Applicant Privacy Statement (“Applicant Statement”) describes ServiceNow, Inc., including its subsidiaries and affiliates (collectively, "ServiceNow," "we," or "us"), privacy practices that apply to our collection, use, and disclosure of personal information from our applicants (“you” and “your”) for employment, including internship opportunities with ServiceNow via our application portals, websites, or other recruitment channels (collectively, “Application Sites”) and from individuals who we engage with about ServiceNow career opportunities.

For the purposes of this Applicant Statement:

  • Job Applicant” means a current or former applicant for employment or engagement with us.
  • Applicant Data” means the information we process in connection with your application and as part of the outreach, interview and screening process.
 

How We Obtain Information

As further described below, we collect several types of information from and about you that broadly fall into the following categories: identifiers, professional or employment‑related information, financial account information, commercial information, education information, visual information and internet activity information, among others.

  1. Information you provide to us as Applicant Data

We may process information you provide to us where permitted or required by law, or as may be necessary or permitted for the purposes described in this Applicant Statement, including but not limited to:

  • Contact information (for example, your name, home and email addresses, telephone number, photo)
  • ID, passport, information relating to nationality, citizenship and/or immigration status
  • Employment and background information, such as job title, academic and professional qualifications, education
  • Compensation information (for example, shares of stock and details about any entitlements to shares of stock awarded)
  • Background check, identity verification and drug screening information
  • Accommodation requests (g., sincerely held religious belief or disability/medical condition)
  • Employment contracts
  • Competency assessments, other learning and skills data
  • Demographic data (such as information about your race, ethnicity, religion, or sexual orientation) if you provide it to us voluntarily
  • Audio recordings, photographs, video recordings, and other similar digital assets (including when you visit us at our office locations)

Information we collect from third parties

We may obtain information about you from other sources, to the extent permitted by applicable law, as may be necessary or permitted to engage with you about ServiceNow career opportunities, in connection with your application and as part of the interview process. For example, we obtain information through your contact with us from third parties such as referees, and from our vendors and other providers, such as employment research firms, competency assessment providers, applicant tracking system providers, candidate relationship management system providers, identity verification and background check or disability/medical accommodation service providers. We may obtain information from websites or public sources ) such as information from public professional networking sites (for example LinkedIn) (subject to such third party’s privacy policies

We may also obtain information as part of corporate transactions.

  1. Information we collect as you navigate through the Application Site

As you navigate through our Application Site, we may also collect certain information from you about your visit to our websites using "cookies" and other similar tracking technologies.

Children

We do not knowingly collect personal information from anyone under the age of 16. If you are under 16, please do not attempt to fill out our forms or send any personal information about yourself to us. If we learn that we have collected Personal Information from a child under age 16, we will delete that information promptly.

 

How We Use Information Collected

We may use information that we collect about you for recruitment and human resources management purposes at a global level, as may be permitted by applicable law or as may be necessary or permitted for a role, including but not limited to:

  • Carrying out and supporting recruiting, hiring, and human resources functions and activities, including processing and evaluating your application, assessing your eligibility to work and for remote work under applicable law and our policies, making hiring decisions, lawful vetting and background screening (including identity verification) and managing and improving our recruiting and hiring processes
  • Carrying out obligations under employment and benefits laws
  • Managing workplace safety and health
  • Managing physical and system security
  • Administering employee participation in benefits, compensation, human resources, and training plans and programs
  • Communicating with you about your application
  • Informing you of future employment opportunities (unless you tell us you do not want to be contacted for such purposes)
  • Complying with legal obligations and internal policies, including those related to export control laws
  • Managing and conducting business activities, including allocating company assets and human resources; project management, records management, and compilation of audit trails or other reporting tools; process development and improvement, including training ServiceNow’s artificial intelligence (“AI”) and machine learning (“ML”) models, in accordance with local laws; managing mergers, acquisitions, sales, re‑organizations, or disposals and integration with purchaser
  • Managing the online career portal and conducting background and other preemployment checks
  • If you are hired, Applicant Information may be used in connection with your employment (for example, to establish an employment record; administer employee participation in benefits and training plans and programs; or conduct onboarding activities, including granting access to internal systems).

In general, we do not require Job Applicants to provide sensitive personal information (such as information about your race, ethnicity, religion, or sexual orientation), but you may provide such information voluntarily at your discretion. If you agree to provide this information, it will be used only for the purposes of providing a suitable working environment for you (for example, if you require disability accommodation) and will not be a factor in the hiring or selection process.

We ask for information about your citizenship/nationality, and for certain roles (e.g. United States federal facing roles) or regions, however, we may ask for health‑related information or sincerely held religious beliefs (e.g., ‑accommodation request) to confirm that we are in compliance with our legal obligations‑. This information will be viewable in the hiring process as it is required for determining eligibility for a specific role.

In some countries and for some roles, we may need to conduct criminal background and drug screening checks, but only where this is required or permitted by applicable laws. If this is the case, any information we process in this regard will be treated in strictest confidence and used only for the purpose of assessing your eligibility for employment or specific job duties with us.

 

How We Share Information Collected

We may disclose personal information contained in Applicant Data to the following categories of recipients:

  • Subsidiaries and affiliates (including those located outside of the European Union and Switzerland) as required for purposes described in this Applicant Statement.
  • Service providers that perform services on our behalf, including for the uses described above. We only authorize our service providers to use or disclose Applicant Data as necessary to perform services on our behalf and only in accordance with our instructions, or to comply with legal requirements. We also require our service providers to appropriately safeguard the privacy and security of Applicant Data. For example, some information may be disclosed to:
  • companies who provide us with services related to confirming your eligibility to work under the law and under our policies;
  • companies who provide us with applicant tracking, candidate relationship management and competency assessment platforms and systems;
  • companies who perform background check and identity verification on ServiceNow’s behalf;
  • companies who provide communications infrastructure (including for data storage purposes) and/or provide security services, business continuity services;
  • third parties who assist in the coordination and provision of relocation services;
  • auditors, advisors, legal representatives and similar agents in connection with the advisory services they provide to us;
  • third parties that provide systems and/or services to host and/or improve our operations, including the internal use of AI features.
  • third parties providing support where permitted for ServiceNow’s purposes as described in this Applicant Statement.
  • A potential buyer(and its agents and advisors) in connection with any proposed merger, acquisition, or any form of sale or transfer of some or all of our assets (including in the event of a reorganization, dissolution or liquidation), in which case Applicant Data held by us will be among the assets transferred to the buyer or acquirer. Should a sale, merger or acquisition occur, we will use reasonable efforts to direct the transferee to use the Applicant Data in a manner consistent with this Applicant Statement.
  • Any competent law enforcement body, regulatory, government agency, court or other third party to: (i) comply with any court order, a request from any competent law enforcement agency, or any other legal obligation; (ii) enforce or apply our Website Terms of Use or terms of any other agreement; and (iii) protect the rights, property, or safety of ServiceNow or others, or other legal obligation.
  • Any other person at your direction or with your consentto the disclosure.

We may also disclose aggregated or de‑identified information, which cannot reasonably be used to identify you. ServiceNow processes, maintains and uses this information only in a de‑identified fashion and will not attempt to re‑identify such information except as permitted by applicable law. 

We do not sell, rent or trade personal information with third parties for their promotional purposes.

 

Legal Basis for Processing

Our legal basis for collecting and using the personal data described above will depend on the personal data concerned and the specific context in which we collect it.

We will normally process personal information as data controller where the processing is in our legitimate interests (such as assessing your suitability for a specific role at ServiceNow) and not overridden by your data protection interests or fundamental rights and freedoms, where this is required for the performance of contract (such as your employment contract), to comply with applicable laws (such as health and safety, tax, or other laws) or where we have your consent to do so. Where we collect special categories of personal information from you, we will do so normally only with your explicit consent or where we have an obligation under applicable law (e.g., employment law) to process such information. International Transfers

We may store and process data covered by this Applicant Statement in (i) any country where we have facilities; and (ii) any country in which we engage service providers, when delegation or storage is necessary. A list of ServiceNow’s global offices is available here.

If you are a visitor from the European Economic Area ("EEA"), we will protect your personal information when it is transferred outside of the EEA by:

  • processing it in a territory which the European Commission has determined provides an adequate level of protection for personal information; or
  • otherwise implementing appropriate safeguards to protect your personal information, including through the use of Standard Contractual Clauses or another lawful transfer mechanism approved by the European Commission.

Security and Confidentiality

We maintain appropriate technical and organizational measures to protect Applicant Data from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, and access. Our employees with access to Applicant Data are required to keep that information confidential and secure.

By submitting a form on our Application Sites, you are agreeing to being contacted by ServiceNow in relation to your application and the recruitment process. We may contact you via email, phone call, or instant messaging (including SMS).

Retention

Unless a longer retention period is required by law, we retain Applicant Data where we have an ongoing legitimate business need to do so or as long as such data is needed to fulfill the purposes outlined in this Applicant Statement. Additionally, we may also retain Applicant Data to consider you for other job opportunities where such retention is permitted by law, unless you do not permit us to retain your Applicant Data for such purposes.

We may delete Applicant Data at any time as permitted or required by law. When we have no legal obligation or ongoing legitimate business need to process your personal information, we will either delete or anonymize it.

 

Your Privacy Rights

  • In addition, if we process your Applicant Data with your consent, you can contact us to withdraw your consentat any time.

We may notify the data subject and require them to independently verify their identity before fulfilling the authorized agent’s request.

We Do Not ‘Share’ or ‘Sell’ Personal Information of Applicants. ServiceNow does not ‘sell’, ‘share’, or use for purposes of targeted advertising personal information that we collect in connection with this Applicant Statement. For personal information that we collect from you through other channels, including our websites or events, we may disclose your personal information to certain third parties in way that could be considered a ‘sale’ or ‘share’ of your personal information. Persons under 18 years old. We do not collect personal information from any persons under the age of 18 years in connection with applications for employment.

You have the right to use an authorized agent to exercise these rights. We may request evidence that have provided such agent with authority to submit requests on your behalf and ask that you verify the agent’s identity directly with us.
